Terms & Policies

1. SERVICES PROVIDED

NorthPoint provides live online educational tutoring services, including one-on-one and small-group sessions. Services may include academic instruction, homework assistance, and test preparation.

NorthPoint does not guarantee academic outcomes, grades, or standardized test score improvements.

All services are educational instructional services and are not subject to Texas sales tax.

2. MEMBERSHIP STRUCTURE & SLOT RESERVATION

Tutoring services are provided through a recurring weekly membership in which membership fees reserve a recurring instructional time slot(s) and dedicated tutor allocation. Payment secures availability of time slot(s) and tutoring services rather than session attendance, and membership is tied to holding the student’s scheduled time slot each week in advance whether or not the session is attended. Membership fees are charged to reserve tutor time and staffing resources in advance, not based on attendance. Temporary nonattendance does not suspend billing, and NorthPoint does not prorate partial weeks. Enrollment fees, if applicable, are one-time and non-refundable.

3. RECURRING BILLING AUTHORIZATION

By enrolling, you expressly authorize NorthPoint K-12 Tutoring to automatically charge your payment method at the beginning of each billing week regardless of attendance for the upcoming week of session time slot(s) and tutoring services. Membership billing is based on reserved time slot(s), not usage This is a recurring weekly membership charge. This authorization remains active until you properly cancel or pause it under Section 6. Billing continues unless and until written cancellation is processed. You agree not to dispute, reverse, or charge back authorized recurring charges that comply with this Agreement. Failure of payment may result in immediate suspension or termination of services.

4. RESCHEDULING POLICY

A minimum of forty-eight (48) hours’ notice is required to reschedule a tutoring session and remains subject to tutor availability. Reschedule requests made with less than forty-eight (48) hours’ notice are considered late and the scheduled session will be charged in full. At NorthPoint’s discretion, families may be offered the option to purchase a discounted makeup session, subject to tutor availability.

5. CANCELLATION & CREDIT POLICY

Cancellations made with at least forty-eight (48) hours’ notice are eligible for full class credit. Cancellations made with less than forty-eight (48) hours’ notice are non-refundable and non-creditable. Any class credits issued are automatically applied and may be used only for future sessions, carry no cash value, and are not redeemable for refunds. Credits expire 60 days from issuance unless otherwise approved by NorthPoint. At NorthPoint’s discretion, families may be offered the option to purchase a discounted makeup session for late cancellations, subject to tutor availability.

6. MANAGING YOUR MEMBERSHIP

To pause or cancel membership, you must notify NorthPoint before your next billing cycle.

Previously billed weeks are non-refundable.

Membership billing continues until a written cancellation is received. Written cancellation must be submitted by email and include the student’s name and scheduled session time(s).

7. CHARGEBACKS & PAYMENT DISPUTES

Filing a chargeback or payment dispute for authorized recurring membership charges constitutes intentional nonpayment and breach of this Agreement. NorthPoint reserves the right to immediately suspend services, permanently terminate membership, recover disputed funds, recover administrative and processing fees, and pursue collection remedies permitted by law.​

8. SESSION RECORDING & CONSENT

All tutoring sessions conducted online may be recorded solely for internal supervision and quality assurance purposes, including tutor training.

Recordings are not used for marketing, not shared publicly, and not distributed to third parties.

Recordings are stored securely and accessed only by authorized NorthPoint K-12 Tutoring personnel.

By enrolling in tutoring services, parents and students acknowledge and consent to session recording for these limited purposes

9. REFUND POLICY

NorthPoint K-12 Tutoring does not offer cash refunds for completed or missed sessions.

All approved adjustments are provided in the form of class credits only. Credits are valid for future sessions only and have no cash value.

10. STUDENT EXPECTATIONS

Students are expected to:

• Arrive on time

• Remain respectful

• Actively participate

• Complete assigned homework on time

Disruptive behavior may result in service termination without refund.

11. TERMINATION RIGHTS

NorthPoint may terminate services for:

• nonpayment

• repeated policy violations

• abusive student or parent behavior

• safety concerns

Terminated memberships are not eligible for refunds

12. LIMITATION OF LIABILITY

NorthPoint is not liable for:

• internet outages

• device failures

• platform disruptions

• technical issues beyond our control

• academic performance

• grades or test scores

Services are provided without guarantee of results.

13. GOVERNING LAW

This Agreement is governed by the laws of the State of Texas. Any disputes arising from this Agreement must be resolved through binding arbitration in Texas. The parties waive the right to trial by jury and agree to resolve disputes exclusively through arbitration.​​

14. PRIVACY & DATA PROTECTION

We collect only the information necessary to provide tutoring services, billing, and communication. Personal information is stored securely and accessed only by authorized personnel. We do not sell or share personal data with third parties except as required for payment processing or legal compliance.

15. POLICY UPDATES

Policies may be updated periodically. Continued use of services from NorthPoint K-12 Tutoring constitutes acceptance of the most current version of these policies.

16. ACCEPTANCE OF TERMS

By enrolling and submitting payment, you acknowledge:

• this is a recurring weekly tutoring membership

• charges occur automatically at the beginning of each week

• attendance does not affect billing

• you authorize automatic charges

• you accept all terms above
